          printed to be committed to the Committee on Rules

        AN ACT to amend the vehicle and traffic law, in relation to establishing
          an amnesty program for any person who has received a ticket for opera-
          tion of an electric assisted bicycle and providing an  exception  from
          the  registration  requirement of motor vehicles for electric assisted
          bicycles; and providing for the repeal of such provisions upon expira-
          tion thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 401-c to read as follows:
     3    § 401-c. Electric assisted bicycle amnesty program. 1.   Notwithstand-
     4  ing  any provision of law to the contrary, the department of motor vehi-
     5  cles shall establish an amnesty program for any individual who has  been
     6  issued  a  ticket  for  a  violation of section four hundred one of this
     7  article while operating  an  electric  assisted  bicycle.  Such  amnesty
     8  program shall allow any person charged with a fine, fee or other penalty
     9  for a violation of section four hundred one of this article to have such
    10  fine,  fee  or other penalty waived for a period of three hundred sixty-
    11  five days from the establishment of such amnesty program.
    12    2. Notwithstanding any provision of law to the contrary, it shall  not
    13  be  a violation of section four hundred one of this article for an elec-
    14  tric assisted bicycle to be operated or driven upon the public  highways
    15  of  this  state  without  first  being registered in accordance with the
    16  provisions of this article.
    17    3. As used in this section, the term "electric assisted bicycle" shall
    18  mean a bicycle with two or three wheels which has  a  saddle  and  fully
    19  operative  pedals  for  human propulsion and also has an electric motor.
    20  The electric assisted bicycle's  electric  motor  shall:  have  a  power
    21  output  of  less than seven hundred fifty watts; have a maximum speed of

     1  less than twenty miles per hour on a paved level  surface  when  powered
     2  solely  by  such  a  motor  while  ridden  by an operator who weighs one
     3  hundred seventy pounds; and be incapable of further increasing the speed
     4  of  the  device when human power is used to propel the device at or more
     5  than twenty miles per hour.
     6    § 2. This act shall take effect immediately and shall  expire  and  be
     7  deemed repealed one year after such date.
