        Introduced  by  Sen.  RAMOS  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules

        AN ACT to amend the vehicle and traffic law, in relation to  the  opera-
          tion  or  riding  upon a bicycle with electric assist by persons under
          the age of sixteen

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivision  2 of section 1242 of the vehicle and traffic
     2  law, as added by a chapter of the laws of 2019, amending the vehicle and
     3  traffic law relating to  bicycles  with  electric  assist  and  electric
     4  scooters,  as  proposed  in  legislative  bills numbers S. 5294-A and A.
     5  7431-B, is amended to read as follows:
     6    2. Notwithstanding the provisions of section  twelve  hundred  thirty-
     7  eight  of  this  article, no person less than sixteen years of age shall
     8  operate or ride as a passenger  upon  a  bicycle  with  electric  assist
     9  unless  such passenger is wearing a helmet meeting standards established
    10  by the commissioner and such passenger is  placed  in  a  separate  seat
    11  attached  to  the  bicycle  with  electric assist, and no person sixteen
    12  years of age or older shall allow any person less than sixteen years  of
    13  age  to  operate  or  ride  as a passenger upon such bicycle unless such
    14  passenger is wearing a  helmet  meeting  standards  established  by  the
    15  commissioner and such passenger is placed in a separate seat attached to
    16  the bicycle with electric assist. The provisions of subdivision seven of
    17  section  twelve hundred thirty-eight of this article shall be applicable
    18  to this subdivision.   Provided,  however,  that  no  person  less  than
    19  sixteen  years  of age shall operate or ride as a passenger upon a class
    20  three bicycle with electric assist, and provided that no person  operat-
    21  ing  a class one or class two bicycle with electric assist shall allow a
    22  person who is under one year of age to ride as a passenger on a  bicycle
    23  nor shall such person be carried in a pack fastened to the operator.

     1    §  2.  This  act  shall  take  effect on the same date and in the same
     2  manner as section 5 of a chapter of the laws of 2019, amending the vehi-
     3  cle and traffic law relating to bicycles with electric assist and  elec-
     4  tric scooters, as proposed in legislative bills numbers S. 5294-A and A.
     5  7431-B, takes effect.
