        Introduced  by Sen. BENJAMIN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules

        AN ACT to amend the executive law, in relation to domestic  violence-re-
          lated  activity  of  the  New  York state office for the prevention of
          domestic violence and adding a member to the advisory council; and  to
          repeal certain provisions of such law relating thereto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (m) of subdivision 3 of section 575 of the execu-
     2  tive law, as relettered by chapter 339 of the laws of  2011,  is  relet-
     3  tered paragraph (n) and a new paragraph (m) is added to read as follows:
     4    (m) promoting best practices for abusive partner intervention;
     5    §  2.  Paragraph  (b) of subdivision 4 of section 575 of the executive
     6  law, as amended by chapter 248 of the laws of 2017, is amended  to  read
     7  as follows:
     8    (b)  The  advisory council shall consist of nine members and [sixteen]
     9  seventeen ex-officio members. Each member shall be  appointed  to  serve
    10  for a term of three years and shall continue in office until a successor
    11  appointed  member is made. A member appointed to fill a vacancy shall be
    12  appointed for the unexpired term of the member he or she is to  succeed.
    13  All  of  the  members shall be individuals with expertise in the area of
    14  domestic violence. Three members shall be appointed by the governor, two
    15  members shall be appointed upon  the  recommendation  of  the  temporary
    16  president  of the senate, two members shall be appointed upon the recom-
    17  mendation of the speaker of the assembly, one member shall be  appointed
    18  upon  the  recommendation  of the minority leader of the senate, and one
    19  member shall be appointed upon the recommendation of the minority leader
    20  of the assembly. The ex-officio members  of  the  advisory  board  shall
    21  consist  of the director of the office, who shall chair the council, and
    22  the following members or their designees: the commissioner of the office
    23  of temporary and disability assistance; the commissioner of the  depart-

     1  ment  of  health;  the  commissioner  of  the  education department; the
     2  commissioner of the office of mental health;  the  commissioner  of  the
     3  office  of  alcoholism and substance abuse services; the commissioner of
     4  the  division  of  criminal  justice services; the superintendent of the
     5  division of state police; the director of the office  of  probation  and
     6  correctional  alternatives;  the  commissioner of the office of children
     7  and family services; the director of the office of victim services;  the
     8  chief  administrative  judge  of the office of court administration; the
     9  commissioner of the department of  labor;  the  director  of  the  state
    10  office  for the aging; the commissioner of the department of corrections
    11  and community supervision;  the  commissioner  of  homes  and  community
    12  renewal;  the  chief  executive  officer of the New York state coalition
    13  against domestic violence; and the executive director of  the  New  York
    14  state coalition against sexual assault.
    15    § 3. Section 576 of the executive law is REPEALED.
    16    § 4. This act shall take effect immediately.
