          printed to be committed to the Committee on Rules

        AN ACT to establish a task force to study and  make  recommendations  on
          backup energy

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. a. A task force is hereby established to study backup ener-
     2  gy in the state of New York. For purposes of this act,  "backup  energy"
     3  shall mean any provision of energy to residents of this state during the
     4  occurrence  when  an  energy  provider  or  utility company is unable or
     5  unwilling to provide such service.
     6    b. Such study shall include:
     7    (i) the current ability of the state to provide backup energy;
     8    (ii) the feasibility of utilizing technologies such as  battery-stored
     9  backup  power, solar power, wind power and fuel cells for backup energy;
    10  and
    11    (iii) any other information the task force deems relevant.
    12    c. No later than one year after the effective date of  this  act,  the
    13  task  force  shall report its findings of such study to the governor and
    14  the legislature, as described under subdivision b of this section.
    15    § 2. a. The task force shall be comprised of  twelve  members,  to  be
    16  appointed as follows:
    17    (i) four members appointed by the governor;
    18    (ii)  four members appointed by the temporary president of the senate;
    19  and
    20    (iii) four members appointed by the speaker of the assembly.
    21    b. One of the appointments by the governor shall serve as  chairperson
    22  of the task force.
    23    c.  The  members  of  the task force shall receive no compensation for
    24  their services, but shall be allowed their actual and necessary expenses
    25  incurred in the performance of their services.

     1    d. All departments,  divisions,  bureaus,  commissions,  districts  or
     2  agencies  of  the  state or any political subdivisions thereof shall, at
     3  the request of the chairperson, provide the task force with such facili-
     4  ties, assistance and data as will enable the task force to carry out its
     5  powers and duties.
     6    § 3. This act shall take effect immediately.
