STATE OF NEW YORK ________________________________________________________________________ 7291 IN SENATE January 5, 2018 ___________ Introduced by Sen. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend a chapter of the laws of 2017, relating to requiring the office for people with developmental disabilities to establish the care demonstration program, as proposed in legislative bills numbers S. 5681 and A. 7399-A, in relation to the services provided, the moni- toring of such program and the effectiveness thereof; and providing for the repeal of certain provisions of such chapter relating thereto The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2 of a chapter of the laws of 2017, relating to 2 requiring the office for people with developmental disabilities to 3 establish the care demonstration program, as proposed in legislative 4 bills numbers S. 5681 and A. 7399-A is REPEALED. 5 § 2. Sections 1, 3 and 4 of a chapter of the laws of 2017, relating to 6 requiring the office for people with developmental disabilities to 7 establish the care demonstration program, as proposed in legislative 8 bills numbers S. 5681 and A. 7399-A, are amended to read as follows: 9 Section 1. (a) The commissioner of the office for people with develop- 10 mental disabilities shall establish the care demonstration program, to 11 utilize the state workforce to provide community based care to individ- 12 uals with developmental disabilities. 13 (b) The services provided by these pilots [shall] may include, but 14 shall not be limited to: 15 (i) community habilitation; 16 (ii) in-home respite; 17 (iii) pathways to employment; 18 (iv) supported employment (SEMP); and 19 (v) community prevocational services. 20 § [3] 2. The commissioner of the office for people with disabilities 21 shall promulgate all rules and regulations necessary to implement the 22 provisions of this section. 23 § [4] 3. This act shall take effect immediately and shall expire and 24 be deemed repealed March 31, [2021] 2020; provided however, that all EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11074-04-7S. 7291 2 1 rules and regulations necessary for the implementation of this act shall 2 have been promulgated prior to such effective date. 3 § 3. This act shall take effect on the same date and in the same 4 manner as a chapter of the laws of 2017, relating to requiring the 5 office for people with developmental disabilities to establish the care 6 demonstration program, as proposed in legislative bills numbers S. 5681 7 and A. 7399-A, takes effect.
