        Introduced  by  Sen.  JORDAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government

        AN ACT relating to giving the Moreau town board the discretion to change
          speed limits

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  1.  Notwithstanding the provisions of section 1622 of the
     2  vehicle and traffic law, in lieu of making a request of  the  department
     3  of  transportation  pursuant to such section, the town board of the town
     4  of Moreau in the county of Saratoga, with respect to town highways which
     5  have been functionally classified by the department of transportation as
     6  local roads on official functional classification maps approved  by  the
     7  federal  highway  administration pursuant to part 470.105 of title 23 of
     8  the code of federal regulations, as amended from time to time, and which
     9  are outside of cities and villages, may by local law, ordinance,  order,
    10  rule or regulation:
    11    (a) Establish maximum speed limits at which vehicles may proceed on or
    12  along  designated town highways lower than the fifty-five miles per hour
    13  statutory maximum speed limit. No such limit  shall  be  established  at
    14  less  than  twenty-five  miles per hour, except that school speed limits
    15  may be established at not less  than  fifteen  miles  per  hour,  for  a
    16  distance  not  to  exceed  one  thousand three hundred twenty feet, on a
    17  highway passing a school building, entrance or exit of a school abutting
    18  on the highway.
    19    (b) Establish maximum speed limits at which vehicles may proceed on or
    20  along all such town highways lying within such towns  or  within  desig-
    21  nated areas of such towns lower than the fifty-five miles per hour stat-
    22  utory  maximum  speed  limit.  No such speed limit applicable throughout
    23  such towns or within designated areas of such towns shall be established
    24  at less than thirty miles per hour.
    25    2. No such speed limits shall be established except in accordance with
    26  the engineering considerations and factors for speed limits set forth in
    27  the New York state manual and specifications for  a  uniform  system  of
    28  traffic control devices as such manual and specifications may be amended

     1  from  time  to  time,  certified by a licensed professional engineer who
     2  specializes in traffic operations.
     3    3.  For  the purposes of this section, the term "New York state manual
     4  and specifications for a uniform  system  of  traffic  control  devices"
     5  shall  mean  the  national  manual  of  uniform  traffic control devices
     6  promulgated by the federal highway administration  pursuant  to  subpart
     7  (f)  of  part 655 of title 23 of the code of federal regulations and the
     8  New York state supplement adopted by the commissioner of  transportation
     9  pursuant  to  section  1680 of the vehicle and traffic law, and the term
    10  "town highways" shall have the same meaning as such term is  defined  by
    11  subdivision 5 of section 3 of the highway law.
    12    4. Nothing contained in this act shall be deemed to alter the authori-
    13  ty of the department of transportation to establish maximum speed limits
    14  at  the request of the town board of the town of Moreau in the county of
    15  Saratoga, with respect to all town highways within such towns outside of
    16  cities and  villages  pursuant  to  subdivision  one  of  this  section,
    17  provided that no maximum speed limits have been established by such town
    18  boards  pursuant to this act on any town highway functionally classified
    19  as a local road within such towns.
    20    § 2. This act shall take effect on the one hundred eightieth day after
    21  it shall have become a law. Effective immediately, the addition,  amend-
    22  ment and/or repeal of any rule or regulation necessary for the implemen-
    23  tation  of  this act on its effective date are authorized to be made and
    24  completed on or before such effective date.
