          printed to be committed to the Committee on Finance

        AN ACT to amend the state finance law, in relation to the New York state
          ALS research and education fund

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivisions  3,  4  and  6  of section 95-i of the state
     2  finance law, as added by chapter 290 of the laws of 2018, are amended to
     3  read as follows:
     4    3. Moneys of the fund shall be expended by the  department  of  health
     5  only  to  provide grants to the Greater New York ALS Association and the
     6  ALS Association Upstate New York  Chapter,  not-for-profit  corporations
     7  established  in  this  state  which  are incorporated for the purpose of
     8  advancing and financing ALS research and  education  projects,  provided
     9  that moneys of the fund shall be expended only in support of the Greater
    10  New  York  ALS  Association's ALSA Certified Treatment Centers of Excel-
    11  lence located in New York state or otherwise in support of  the  Greater
    12  New York ALS Association's work in New York state.
    13    4.  On  or before the first day of February each year, the comptroller
    14  shall certify to the governor, temporary president of the senate, speak-
    15  er of the assembly, chair of the senate finance committee and  chair  of
    16  the  assembly ways and means committee, the amount of money deposited by
    17  source in the New York state ALS research and education fund during  the
    18  preceding  calendar  year  as  the result of revenue derived pursuant to
    19  sections two hundred nine-L and six hundred thirty-f of the tax law  and
    20  from  all  other sources, as well as all disbursements from the New York
    21  state ALS research and education  fund  during  the  preceding  calendar
    22  year. The [comptroller] commissioner of health shall expend funds in the
    23  year  in which they were donated to the extent practicable. In the event
    24  that any such funds were not expended in the year  in  which  they  were
    25  donated,  the  [comptroller] commissioner of health shall provide justi-
    26  fication, along with a remedial plan to ensure the timely and  effective
    27  use  of the funds in the annual report to the governor, temporary presi-

     1  dent of the senate, speaker of the assembly, chair of the senate finance
     2  committee and chair of the assembly ways and means committee.
     3    6.  Moneys  shall be payable from the fund to the Greater New York ALS
     4  Association and the ALS  Association  Upstate  New  York  Chapter,  with
     5  sixty-five  percent of moneys in the fund to be allocated to the Greater
     6  New York ALS Association and thirty-five percent of moneys in  the  fund
     7  to  be  allocated  to the ALS Association Upstate New York Chapter on an
     8  annual basis, on the audit and warrant of the  comptroller  on  vouchers
     9  certified and approved by the [comptroller] commissioner of health.
    10    §  2.  This  act  shall take effect immediately and shall be deemed to
    11  have been in full force and effect on and after October 1, 2018.
