STATE OF NEW YORK ________________________________________________________________________ 8134 IN SENATE April 6, 2018 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to creating a cashless tolling amnesty program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public authorities law is amended by adding a new 2 section 354-a to read as follows: 3 § 354-a. Cashless tolling amnesty program. 1. Notwithstanding any 4 section of this title or any other law, the authority shall provide an 5 amnesty program for any person, firm, corporation, or other entity 6 charged with the payment of a cashless toll fee for the use of any 7 bridge or highway operated by the authority. 8 2. Such amnesty program shall allow any person, firm, corporation, or 9 other entity charged with the payment of a cashless toll fee for the use 10 of any bridge or highway operated by the authority to pay such tolls in 11 full and to have any toll violation fees related to such paid tolls 12 waived for a period of six months from the commencement of cashless 13 tolling on a bridge or highway, or six months from the effective date of 14 this section, whichever is later. 15 3. Notwithstanding any section of this title or any other law, any 16 cashless toll violation fee charged to any person, firm, corporation, or 17 other entity for the use of any bridge or highway operated by the 18 authority shall not exceed twice the amount of the toll charged for 19 using such bridge or highway for a period of ninety days from the effec- 20 tive date of this section or from the commencement of cashless tolling 21 on such bridge or highway, whichever is greater, and shall not exceed 22 three times the amount of the toll charged for using such bridge or 23 highway for an additional ninety day period following the initial ninety 24 day period. 25 § 2. Section 1266 of the public authorities law is amended by adding a 26 new subdivision 3-b to read as follows: 27 3-b. The authority shall conspicuously post on its website the most 28 current version of its fee waiver policy. 29 § 3. This act shall take effect immediately.
