STATE OF NEW YORK ________________________________________________________________________ 8146 IN SENATE April 8, 2020 ___________ Introduced by Sen. FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to granting peace officer status to officers and members of the security force of Rochester General Hospital The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2.10 of the criminal procedure law is amended by 2 adding a new subdivision 86 to read as follows: 3 86. Officers and members of the security force employed by the Roches- 4 ter General Hospital. Officers employed by the Rochester General Hospi- 5 tal shall have the powers of peace officers within the geographic area 6 occupied by the Rochester General Hospital, including the grounds and 7 premises owned, controlled, or administered by the Rochester General 8 Hospital, and any public street and sidewalk that abuts the grounds, 9 buildings or property of such grounds and premises. These officers shall 10 only have the powers listed in paragraphs (a), (b), (c), (d), (e), (h), 11 and (i) of subdivision one of section 2.20 of this article, as well as 12 the power to detain an individual for a reasonable period of time while 13 awaiting the arrival of law enforcement, provided that the officer has 14 actual knowledge, or probable cause to believe, that such individual has 15 committed an offense; provided however, that nothing in this subdivision 16 shall be deemed to authorize such officer to carry, possess, repair or 17 dispose of a firearm unless the appropriate license therefor has been 18 issued pursuant to section 400.00 of the penal law. 19 § 2.
