STATE OF NEW YORK ________________________________________________________________________ 8225 IN SENATE April 27, 2020 ___________ Introduced by Sen. MONTGOMERY -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Development and Small Business AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 7 of section 64 of the alcoholic beverage 2 control law is amended by adding a new paragraph (e-12) to read as 3 follows: 4 (e-12) Notwithstanding the provisions of paragraph (a) of this subdi- 5 vision, the authority may issue a retail license for on-premises 6 consumption for a premises which shall be located within two hundred 7 feet of a building occupied as a church, synagogue or other place of 8 worship, provided such premises constitute a premises for the sale of 9 food or beverages at retail for consumption on the premises located 10 wholly within the boundaries of the Borough of Brooklyn, county of 11 Kings, bounded and described as follows: 12 ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and 13 improvements thereon erected, situate, lying and being in the Borough of 14 Brooklyn, County of Kings, City and State of New York, bounded and 15 described as follows: 16 BEGINNING at a point on the northerly side of Lafayette Avenue, 17 distant 43 feet westerly from the corner formed by the intersection of 18 the northerly side of Lafayette Avenue with the westerly side of St. 19 Felix Street, which point is opposite the center line of a party wall on 20 the premises herein described and the premises adjoining on the east; 21 RUNNING THENCE westerly along the northerly side of Lafayette Avenue, 22 21 feet 6 inches to a point opposite the center line of another party 23 wall on the premises herein described and premises adjoining on the 24 west; 25 THENCE northerly parallel with the westerly side of St. Felix Street, 26 and part of the distance through a party wall, 100 feet to a point 27 distant 63 feet westerly (deed) 64 feet 6 inches (tax map) from the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
