BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT authorizing the commissioner of general services to convey certain unused state lands to MCB-Eagle New Paltz, LLC The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act and notwithstanding 2 any other provision of law to the contrary, the commissioner of general 3 services, upon the consent of the commissioner of the department of 4 environmental conservation, is hereby authorized and empowered to trans- 5 fer and convey to MCB-Eagle New Paltz, LLC, certain unused state land 6 consisting of a portion of the Department of Environmental Conservation 7 Region 3 Headquarters under the jurisdiction of the department of envi- 8 ronmental conservation, in consideration of fair market value and upon 9 such other terms and conditions as the commissioner of general services 10 may deem proper. 11 § 2. The land authorized to be transferred and conveyed pursuant to 12 this act is a portion of the department of environmental conservation 13 region 3 headquarters and is generally described as follows: 14 ALL that piece or parcel of land situate in the Town of New Paltz, 15 County of Ulster, and State of New York being more particularly bounded 16 and described as follows: 17 BEGINNING at a point on the westerly bounds of South Putt Corners Road 18 and at the southerly corner of lands of MCB-Eagle New Paltz, LLC, L. 19 6101 - P.21; 20 THENCE from said point of beginning and following the said road bounds 21 South 23 degrees 22 minutes 16 seconds West a distance of 15.02 feet to 22 a point; 23 THENCE running through the lands of The People of the State of New 24 York, L. 1168 - P.465 (NYS Department of Environmental Conservation) 25 North 63 degrees 54 minutes 02 seconds West a distance of 587.59 feet to 26 a point; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15449-01-8S. 8338 2 1 THENCE further along the same North 26 degrees 05 minutes 58 seconds 2 East a distance of 15.00 feet to a point at the westerly corner of said 3 lands of MCB-Eagle New Paltz, LLC, L. 6101 - P.21; 4 THENCE following the bounds of said lands South 63 degrees 54 minutes 5 02 seconds East a distance of 586.88 feet to the point of beginning and 6 containing approximately 0.20 acres. 7 § 3. The description in section two of this act of the lands to be 8 transferred and conveyed is not intended to be a legal description, but 9 is intended only to identify the premises to be conveyed. As a condition 10 of purchase, MCB-Eagle New Paltz, LLC shall submit to the commissioner 11 of general services for approval an accurate survey and description of 12 the lands generally described in section two of this act, which may be 13 used in the conveyance thereof. 14 § 4. The commissioner of general services shall not transfer or convey 15 the aforesaid land unless application is made by MCB-Eagle New Paltz, 16 LLC, within one year after the effective date of this act. 17 § 5. This act shall take effect immediately.
