        Introduced  by  Sen.  RAMOS  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules

        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          authorizing  the  issuance  of  a temporary retail permit by the state
          liquor authority to licensees located in a municipality having a popu-
          lation of one million or more persons

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (b) of subdivision 1 of section 97-a of the alco-
     2  holic beverage control law, as added by chapter 396 of the laws of 2010,
     3  is amended to read as follows:
     4    (b)  to  the applicant for a new retail license [where the prospective
     5  licensed premises is located in a municipality with a population of less
     6  than one million during the period that the application is pending].
     7    § 2. This act shall take effect immediately; provided,  however,  that
     8  the  amendments to paragraph (b) of subdivision 1 of section 97-a of the
     9  alcoholic beverage control law made by section one of this act shall not
    10  affect the repeal of such paragraph and shall be deemed repealed  there-
    11  with.
