STATE OF NEW YORK ________________________________________________________________________ 9124 IN SENATE June 27, 2018 ___________ Introduced by Sen. O'MARA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT directing the department of environmental conservation to conduct a study on the life cycle of battery use and disposal; directing such department to develop options and recommendations for a battery recy- cling collection program and a battery recycling outreach and educa- tion program; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The department of environmental conservation is authorized 2 and directed to conduct a study on the life cycle of battery use and 3 disposal. 4 § 2. The scope of the study shall include, but not be limited to: 5 (a) environmentally sound battery recycling practices; 6 (b) existing battery recycling programs; 7 (c) funding of a battery recycling program, with consideration for 8 battery producers funding the program; 9 (d) current hazardous waste plans; 10 (e) methods of battery collection which includes an emphasis on 11 convenience for customers; 12 (f) analysis of statewide, local, or joint governance over a battery 13 recycling collection program; 14 (g) transportation of batteries recycled through a battery recycling 15 collection program; 16 (h) how to implement a battery recycling collection program throughout 17 the state given its varied population densities; and 18 (i) the use of battery stewardship organizations in a battery recycl- 19 ing collection program. 20 § 3. The department of environmental conservation shall provide a 21 report to the governor and the legislature on or before January 1, 2020. 22 Such report shall include: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15711-01-8S. 9124 2 1 (a) an analysis of options for a battery recycling collection program 2 which include transparent reporting and performance goals for responsi- 3 ble parties; 4 (b) an analysis of options for a battery recycling outreach and educa- 5 tion program; and 6 (c) recommendations on both battery recycling collection programs and 7 battery recycling outreach and education programs. 8 § 4. This act shall take effect immediately and shall expire and be 9 deemed repealed April 1, 2020.
