section 4507.06 of the Revised Code that is | 6 |
scheduled to take effect January 1, 2017, to | 7 |
continue the provisions of this act on and after | 8 |
that effective date. | 9 |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4507.06 of the Revised Code be | 10 |
amended to read as follows: | 11 |
Sec. 4507.06. (A)(1) Every application for a driver's | 12 |
license or motorcycle operator's license or endorsement, or | 13 |
duplicate of any such license or endorsement, shall be made upon | 14 |
the approved form furnished by the registrar of motor vehicles and | 15 |
shall be signed by the applicant. | 16 |
Every application shall state the following: | 17 |
(a) The applicant's name, date of birth, social security | 18 |
number if such has been assigned, sex, general description, | 19 |
including height, weight, color of hair, and eyes, residence | 20 |
address, including county of residence, duration of residence in | 21 |
this state, and country of citizenship; | 22 |
(b) Whether the applicant previously has been licensed as an | 23 |
operator, chauffeur, driver, commercial driver, or motorcycle | 24 |
operator and, if so, when, by what state, and whether such license | 25 |
is suspended or canceled at the present time and, if so, the date | 26 |
of and reason for the suspension or cancellation; | 27 |
(c) Whether the applicant is now or ever has been afflicted | 28 |
with epilepsy, or whether the applicant now is suffering from any | 29 |
physical or mental disability or disease and, if so, the nature | 30 |
and extent of the disability or disease, giving the names and | 31 |
addresses of physicians then or previously in attendance upon the | 32 |
applicant; | 33 |
(d) Whether an applicant for a duplicate driver's license, or | 34 |
duplicate license containing a motorcycle operator endorsement has | 35 |
pending a citation for violation of any motor vehicle law or | 36 |
ordinance, a description of any such citation pending, and the | 37 |
date of the citation; | 38 |
(e) Whether the applicant wishes to certify willingness to | 39 |
make an anatomical gift under section 2108.05 of the Revised Code, | 40 |
which shall be given no consideration in the issuance of a license | 41 |
or endorsement; | 42 |
(f) Whether the applicant has executed a valid durable power | 43 |
of attorney for health care pursuant to sections 1337.11 to | 44 |
1337.17 of the Revised Code or has executed a declaration | 45 |
governing the use or continuation, or the withholding or | 46 |
withdrawal, of life-sustaining treatment pursuant to sections | 47 |
2133.01 to 2133.15 of the Revised Code and, if the applicant has | 48 |
executed either type of instrument, whether the applicant wishes | 49 |
the applicant's license to indicate that the applicant has | 50 |
executed the instrument; | 51 |
(g) On and after October 7, 2009, whether the applicant is a | 52 |
veteran, active duty, or reservist of the armed forces of the | 53 |
United States and, if the applicant is such, whether the applicant | 54 |
wishes the applicant's license to indicate that the applicant is a | 55 |
veteran, active duty, or reservist of the armed forces of the | 56 |
United States by a military designation on the license. | 57 |
(2) Every applicant for a driver's license shall be | 58 |
photographed in color at the time the application for the license | 59 |
is made. The application shall state any additional information | 60 |
that the registrar requires. | 61 |
(B) A person who is not a citizen of the United States shall | 62 |
be eligible to receive an Ohio driver's license or motorcycle | 63 |
operator's license or endorsement only if that person presents, | 64 |
along with the application, documents sufficient to establish one | 65 |
of the following: | 66 |
(1) The person is an alien lawfully admitted for permanent or | 67 |
temporary residence in the United States; | 68 |
(2) The person has conditional permanent resident status in | 69 |
the United States; | 70 |
(3) The person has an approved application for asylum in the | 71 |
United States or has entered into the United States in refugee | 72 |
status; | 73 |
(4) The person has a valid unexpired nonimmigrant visa or | 74 |
nonimmigrant visa status for entry into the United States; | 75 |
(5) The person has a pending application for asylum in the | 76 |
United States; | 77 |
(6) The person has a pending or approved application for | 78 |
temporary protected status in the United States; or | 79 |
(7) The person has a pending application for adjustment of | 80 |
status to that of an alien lawfully admitted for permanent | 81 |
residence in the United States or conditional permanent resident | 82 |
status in the United States. | 83 |
(C) The registrar or a deputy registrar, in accordance with | 84 |
section 3503.11 of the Revised Code, shall register as an elector | 85 |
any person who applies for a driver's license or motorcycle | 86 |
operator's license or endorsement under division (A) of this | 87 |
section, or for a renewal or duplicate of the license or | 88 |
endorsement, if the applicant is eligible and wishes to be | 89 |
registered as an elector. The decision of an applicant whether to | 90 |
register as an elector shall be given no consideration in the | 91 |
decision of whether to issue the applicant a license or | 92 |
endorsement, or a renewal or duplicate. | 93 |

with section 3503.11 of the Revised Code, shall offer the | 95 |
opportunity of completing a notice of change of residence or | 96 |
change of name to any applicant for a driver's license or | 97 |
endorsement under division (A) of this section, or for a renewal | 98 |
or duplicate of the license or endorsement, if the applicant is a | 99 |
registered elector who has changed the applicant's residence or | 100 |
name and has not filed such a notice. | 101 |

and after October 7, 2009, the approved form furnished by the | 103 |
registrar of motor vehicles for an application for a driver's | 104 |
license or motorcycle operator's license or endorsement or an | 105 |
application for a duplicate of any such license or endorsement | 106 |
shall inform applicants that the applicant must present a copy of | 107 |
the applicant's DD-214 or an equivalent document in order to | 108 |
qualify to have the license or duplicate indicate that the | 109 |
applicant is a veteran, active duty, or reservist of the armed | 110 |
forces of the United States based on a request made pursuant to | 111 |
division (A)(1)(g) of this section. | 112 |
Section 2. That existing section 4507.06 of the Revised Code | 113 |
is hereby repealed. | 114 |
Section 3. That the version of section 4507.06 of the | 115 |
Revised Code that is scheduled to take effect January 1, 2017, be | 116 |
amended to read as follows: | 117 |
Sec. 4507.06. (A)(1) Every application for a driver's | 118 |
license, motorcycle operator's license or endorsement, or | 119 |
motor-driven cycle or motor scooter license or endorsement, or | 120 |
duplicate of any such license or endorsement, shall be made upon | 121 |
