A BILL
To amend section 4505.01 and to enact section1
4505.063 of the Revised Code to apply the motor2
vehicle certificate of title law to trailers and3
semitrailers that weigh 4,000 pounds or less and 4
are not farm trailers.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4505.01 be amended and section 6
4505.063 of the Revised Code be enacted to read as follows:7

       Sec. 4505.01.  (A) As used in this chapter:8

       (1) "Lien" includes, unless the context requires a different9
meaning, a security interest in a motor vehicle.10

       (2) "Motor vehicle" includes manufactured homes, mobile11
homes, recreational vehicles, and trailers and semitrailers, but 12
does not include any trailer or semitrailer used in direct 13
agricultural production whose weight exceedsdoes not exceed four 14
thousand pounds.15

       (B) The various certificates, applications, and assignments16
necessary to provide certificates of title for manufactured homes,17
mobile homes, recreational vehicles, and those trailers and 18
semitrailers whose weight exceeds four thousand poundsfor which a 19
certificate of title is required under this chapter, shall be made 20
upon forms prescribed by the registrar of motor vehicles.21

       Sec. 4505.063. (A) Notwithstanding section 4505.06 of the 22
Revised Code, if a certificate of title previously has not been 23
issued for a trailer whose weight is four thousand pounds or less, 24
the application for a certificate of title when required by this 25
chapter shall be accompanied by a manufacturer's or importer's 26
certificate; by a sworn statement of ownership; or by a 27
certificate of title, bill of sale, or other evidence of ownership 28
required by law of another state from which the trailer was 29
brought into this state. If such a trailer is assembled from 30
component parts by a person other than a manufacturer, the owner 31
of the trailer is not required to have the trailer inspected by 32
the state highway patrol under section 4505.111 of the Revised 33
Code in order to apply for and obtain a certificate of title for 34
the trailer.35

        The registrar of motor vehicles, in accordance with Chapter 36
119. of the Revised Code, shall prescribe the form of the sworn 37
statement of ownership and the types of additional documentation 38
sufficient to establish proof of ownership, including, but not 39
limited to, receipts from the purchase of parts or components, 40
photographs, and affidavits of other persons.41

       (B) On and after the effective date of this section, if a 42
trailer is assembled from component parts by a person other than a 43
manufacturer and the trailer weighs four thousand pounds or less, 44
the owner of the trailer is not required to have the trailer 45
inspected by the state highway patrol under section 4505.111 of 46
the Revised Code in order to apply for and obtain a certificate of 47
title for the trailer. The owner may apply for a certificate of 48
title for the trailer by complying with any applicable provision 49
of division (A) of this section.50

       Section 2. That existing section 4505.01 of the Revised Code 51
is hereby repealed.52
