Bill Title: To prohibit a convicted sex offender from possessing a photograph of the offender's victim while the offender is serving a term of confinement for that offense and to prohibit a child-victim offender from possessing a photograph of any minor child while the child-victim offender is serving a term of confinement for that offense.

A BILL
To enact section 2950.17 of the Revised Code to 1
prohibit a convicted sex offender from possessing 2
a photograph of the offender's victim while the 3
offender is serving a term of confinement for that 4
offense and to prohibit a child-victim offender 5
from possessing a photograph of any minor child 6
while the child-victim offender is serving a term 7
of confinement for that offense.8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 2950.17 of the Revised Code be 9
enacted to read as follows:10

       Sec. 2950.17. (A) Regardless of when the sexually oriented 11
offense or child-victim oriented offense was committed, a person 12
who is convicted of, pleads guilty to, has been convicted of, or 13
has pleaded guilty to a sexually oriented offense or a 14
child-victim oriented offense or a person who is or has been 15
adjudicated a delinquent child for committing a sexually oriented 16
offense or a child-victim oriented offense shall not possess a 17
photograph of the victim of the sexually oriented offense or 18
child-victim oriented offense while the person is serving any 19
prison term, jail term, community residential sanction, or other 20
term of confinement imposed on the offender for the offense.21

       (B) Regardless of when the child-victim oriented offense was 22
committed, a person who is convicted of, pleads guilty to, has 23
been convicted of, or has pleaded guilty to a child-victim 24
oriented offense or a person who is or has been adjudicated a 25
delinquent child for committing a child-victim oriented offense 26
shall not possess a photograph of any minor child while the person 27
is serving any prison term, jail term, community residential 28
sanction, or other term of confinement imposed on the offender for 29
the offense.30

       (C) Whoever violates this section is guilty of illegal 31
possession of a prohibited photograph, a misdemeanor of the first 32
degree.33
