AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, in snowmobiles and all-terrain vehicles, further

3

providing for definitions, for restricted account and for

4

registration of snowmobile or ATV; providing for vintage

5

snowmobile permits; and making an editorial change.

6

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Section 7702 of Title 75 of the Pennsylvania

Consolidated Statutes is amended by adding a definition to read:

10

Section 1.  The definition of "snowmobile" in section 7702 of

11

Title 75 of the Pennsylvania Consolidated Statutes is amended

12

and the section is amended by adding definitions to read:

13

§ 7702.  Definitions.

14

The following words and phrases when used in this chapter

15

shall have, unless the context clearly indicates otherwise, the

16

meanings given to them in this section:

"Snowmobile."  An engine-driven vehicle which is all of the

following:

(1)  Is designed to travel over snow or ice.

4

(2)  Has an endless belt track or tracks.

5

(3)  Is steered by a ski or skis.

6

(4)  Has an overall width of 48 inches or less.

7

The term does not include a farm tractor, construction

8

equipment, military vehicle, vehicle with inflatable tires or

9

machinery used strictly for the grooming of snowmobile trails.

10

The term includes vintage snowmobiles.

"Vintage snowmobile."  A snowmobile that is at least 25 years

13

old and is not operated in this Commonwealth except at vintage

14

snowmobile events.

15

"Vintage snowmobile event."  Any ride or rally intended for

16

participation by vintage snowmobiles on a designated trail, on a

17

specific date, with a specified beginning and end point.

Section 2.  Section 7706(a)(1) of Title 75 is amended to

19

read:

20

§ 7706.  Restricted account.

21

(a)  Deposit and use of moneys.--

22

(1)  The department shall deposit the following into a

23

restricted account, which is hereby established:

24

(i)  all moneys received from the registration of and

25

issuance of certificates of title for snowmobiles and

26

ATV's and from the issuance of vintage snowmobile

27

permits;

28

(ii)  all revenue from the sale of any publications

29

or services relating to snowmobiles and ATV's; and

30

(iii)  all fines, penalties, fees and costs assessed

and collected as a result of enforcement activities

2

conducted by the department's law enforcement personnel

3

under this chapter.

Section 3.  Subchapter B heading of Chapter 77 of Title 75 is

6

amended to read:

SUBCHAPTER B

CERTIFICATES OF TITLE [AND], REGISTRATION AND PERMITS

9

Section 4.  Section 7711.1(f) of Title 75 is amended by

10

adding a paragraph to read:

11

§ 7711.1.  Registration of snowmobile or ATV.

12

(f)  Exemptions from registration.--Subsection (a) does not

14

apply if:

15

(5)  The snowmobile is a vintage snowmobile and the owner

17

thereof displays a valid vintage snowmobile permit.

Section 5.  Sections 7712.1(g), 7715.2(a) and 7716 of Title

75 are amended to read:

§ 7712.1.  Certificate of title for snowmobile or ATV.

(g)  Registration without certificate of title prohibited.--

23

Except as provided in subsection (b), the department shall not

24

issue a registration certificate or limited registration

25

certificate for a snowmobile or ATV or a vintage snowmobile

26

permit for a vintage snowmobile unless a certificate of title

27

has been issued by the department to the owner or an application

28

for a certificate of title has been delivered by the owner to

29

the department.

§ 7715.2.  Fees.

2

(a)  Fees.--Except as provided in subsection (b), the

3

department shall collect the following fees:

4

(1)  Certificate of title, $22.50.

5

(2)  Expiration sticker, $20.

6

(2.1)  Vintage snowmobile permit, $35.

7

(3)  Dealer registration, $25.

8

(4)  Replacement, due to loss or damage, of registration

9

certificate, limited registration certificate, registration

10

decal, registration plate [or], expiration sticker or vintage

11

snowmobile permit, $5.

12

(5)  Transfer of registration pursuant to section 7711.1

13

(relating to registration of snowmobile or ATV), $5.

14

(6)  Recording the name of a secured party on a

15

certificate of title, $5.

§ 7716.  Records.

18

The department shall maintain a record, which shall be made

19

available to all enforcement agencies, of:

20

(1)  The registration number for each snowmobile and ATV

21

for which a registration certificate or limited registration

22

certificate is issued.

23

(2)  The name and address of the owner of each snowmobile

24

and ATV for which a registration certificate or limited

25

registration certificate is issued.

26

(3)  The permit number for each vintage snowmobile for

27

which a vintage snowmobile permit is issued.

28

(4)  The name and address of the owner of each vintage

29

snowmobile for which a vintage snowmobile permit is issued.

Section 5 6.  Title 75 is amended by adding a section to

§ 7718.  Vintage snowmobile permits.

3

(a)  Issuance of permits.--

<--

4

(1)  The department shall issue vintage snowmobile

5

permits in accordance with the provisions of this section and

6

shall establish a process that utilizes issuing agents to

7

sell vintage snowmobile permits to an organizer of a vintage

8

snowmobile event or any interested vintage snowmobile owner.

9

(2)  An issuing agent may be a retail business that has

10

an interest in providing vintage snowmobile permits to

11

vintage snowmobile owners.

12

(3)  In order to be eligible for issuance of a vintage

13

snowmobile permit, a person must be a resident of this

14

Commonwealth, submit the necessary application to the

15

department and pay the required fee.

16

(b)  Rights under permit.--

17

(1)  A person who is issued a vintage snowmobile permit

18

is authorized to operate the vintage snowmobile for which the

19

permit is issued only for the purposes of traveling to and

20

from and participating in an exhibition or other event of

21

interest open to the public.

22

(2)  A vintage snowmobile permit is valid only for the

23

person to whom it is issued and is not transferrable.

24

(c)  Permit fee.--The fee for the issuance of a vintage

25

snowmobile permit is $10.

26

(d)  Insurance.--The owner of a vintage snowmobile who has

27

been issued a vintage snowmobile permit under this section shall

28

not be required to display a registration number or carry

29

insurance for the vintage snowmobile.

30

(a)  Issuance of permits.--Upon receipt of an application

therefor upon a form prescribed and furnished by the department

2

which shall contain information required by the department and

3

which shall be accompanied by the required fee and any other

4

information the department shall require, the department shall

5

issue to an owner of a vintage snowmobile a vintage snowmobile

6

permit containing the permit number.

7

(b)  Carrying and exhibiting permit.--Every permit shall, at

8

all times while the vehicle is being operated, be in the

9

possession of the person driving or in control of the vehicle or

10

carried in the vehicle and shall be exhibited upon demand of any

11

police officer or authorized department employee.

12

(c)  Not transferrable.--A vintage snowmobile permit is not

13

transferrable to a successor owner or to another vehicle. Upon

14

transfer of ownership of a vintage snowmobile for which a

15

vintage snowmobile permit has been issued, the permit shall

16

become invalid.

17

(d)  Suspension or revocation.--The department may suspend or

18

revoke a vintage snowmobile permit upon conviction of any

19

offense under this chapter. A suspended or revoked vintage

20

snowmobile permit is invalid.

Section 6 7.  This act shall take effect in 60 days.
