| AN ACT |
| |
1 | Amending Title 35 (Health and Safety) of the Pennsylvania |
2 | Consolidated Statutes, in emergency telephone service, |
3 | providing for prohibited release of information. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 35 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 5399. Prohibited release of information. |
9 | (a) Prohibition.--In a response to a request for a record |
10 | under section 708(b)(18) of the act of February 14, 2008 (P.L.6, |
11 | No.3), known as the Right-to-Know Law, a PSAP may not release a |
12 | record or part of a record containing identifying information |
13 | related to an individual calling a 911 center unless a court of |
14 | competent jurisdiction determines that the public interest in |
15 | disclosure outweighs the interest in nondisclosure. |
16 | (b) Definition.--As used in this section, the term |
17 | "identifying information" includes name, telephone number, |
