AN ACT

Amending Title 35 (Health and Safety) of the Pennsylvania

2

Consolidated Statutes, in emergency telephone service,

3

providing for prohibited release of information.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Title 35 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 5399.  Prohibited release of information.

(a)  Prohibition.--In a response to a request for a record

10

under section 708(b)(18) of the act of February 14, 2008 (P.L.6,

11

No.3), known as the Right-to-Know Law, a PSAP may not release a

12

record or part of a record containing identifying information

13

related to an individual calling a 911 center unless a court of

14

competent jurisdiction determines that the public interest in

15

disclosure outweighs the interest in nondisclosure.

16

(b)  Definition.--As used in this section, the term

17

"identifying information" includes name, telephone number,

address and location.

Section 2.  This act shall take effect in 60 days.
