AN ACT

Amending Title 66 (Public Utilities) of the Pennsylvania

2

Consolidated Statutes, providing for the discontinuance of

3

rate class, schedule or rider and for additional notice

4

requirements.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 1308 of Title 66 of the Pennsylvania

8

Consolidated Statutes is amended by adding subsections to read:

9

§ 1308.  Voluntary changes in rates.

10

(g)  Additional notice requirements.--In addition to the

12

notices required by this section, the commission shall establish

13

regulations requiring public utilities to provide additional

14

notice to customers of proposed tariff changes which affect the

15

availability of an existing rate to such customers, such as the

16

proposed discontinuance of a rate class, schedule or rider.

17

(h)  Discontinuance of rate class, schedule or rider.--The

18

commission shall establish regulations to require a phaseout

period of no less than three years from the date the commission

2

finally approves a public utility's application to discontinue a

3

rate class, schedule or rider unless the commission determines

4

that it is just and reasonable for the public utility to

5

establish a shorter phaseout period. The commission shall not

6

permit any recovery of costs associated with providing a

7

phaseout under this subsection.

Section 2.  This act shall take effect immediately.
