AN ACT

Amending Title 62 (Procurement) of the Pennsylvania Consolidated

Statutes, prohibiting Commonwealth agencies from awarding

3

contracts to bidders engaged in outsourcing of jobs or

4

functions.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Title 62 of the Pennsylvania Consolidated

8

Statutes is amended by adding a section to read:

9

§ 109.  Prohibiting contract awards to bidders that outsource.

10

No Commonwealth agency may award a contract on or after the

11

effective date of this section to any bidder, offeror or other

12

person that has had a net loss of one or more employees in the

13

United States within the three years prior to submitting its bid

14

or offer on the contract, which was caused by the relocation of

15

jobs previously performed at a physical location within the

16

boundaries of the United States to any physical location outside

17

the boundaries of the United States.

Section 2.  This act shall take effect in 30 days.
