AN ACT

Amending the act of August 26, 1971 (P.L.351, No.91), entitled

2

"An act providing for a State Lottery and administration

3

thereof; authorizing the creation of a State Lottery

4

Commission; prescribing its powers and duties; disposition of

5

funds; violations and penalties therefor; exemption of prizes

6

from State and local taxation and making an appropriation,"

7

further providing for the Pharmaceutical Assistance Contract

8

for the Elderly Needs Enhancement Tier.

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

Section 1.  Section 519(b) of the act of August 26, 1971

12

(P.L.351, No.91), known as the State Lottery Law, amended July

13

7, 2006 (P.L.1061, No.111), is amended to read:

14

Section 519.  The Pharmaceutical Assistance Contract for the

15

Elderly Needs Enhancement Tier.

(b)  PACENET eligibility.--[A] 

18

(1)  Subject to annual adjustment under paragraph (2), a 

19

person with an annual income of not less than $14,500 and not

more than $23,500 in the case of a single person and of not

2

less than $17,700 and not more than $31,500 in the case of

3

the combined income of persons married to each other shall be

4

eligible for enhanced pharmaceutical assistance under this

5

section. A person may, in reporting income to the department,

6

round the amount of each source of income and the income

7

total to the nearest whole dollar, whereby any amount which

8

is less than 50ยข is eliminated.

9

(2)  Notwithstanding any other law, the minimum and

10

maximum income levels under paragraph (1) shall be adjusted

11

annually to reflect the maximum annual Social Security cost-

12

of-living adjustment. Each year's adjustment shall be based

13

on the prior year's minimum and maximum income levels. The

14

adjustment required under this paragraph shall reflect

15

calendar years 2008, 2009, 2010 and each calendar year

16

thereafter.

Section 2.  This act shall be retroactive to January 1, 2007.

Section 3.  This act shall take effect immediately.
