AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in terms and courses of study,

6

providing for use of historical writings, documents and

7

records with religious references in public schools.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

11

as the Public School Code of 1949, is amended by adding a

12

section to read:

Section 1511.2.  Use of Historical Writings, Documents and

14

Records With Religious References in Public Schools.--(a)  In

15

conformance with provisions of 22 Pa. Code Ch. 4 (relating to

16

academic standards and assessment), a board of school directors

17

in a school district may allow and encourage any teacher or

administrator in the school district to read or post in a public

2

school building or classroom or during any school-sponsored or

3

school-related event any excerpts or portions of the following:

4

(1)  The Preamble to the Constitution of Pennsylvania.

5

(2)  The Declaration of Independence.

6

(3)  The Constitution of the United States.

7

(4)  The Mayflower Compact.

8

(5)  The national motto.

9

(6)  The National Anthem.

10

(7)  The Pledge of Allegiance.

11

(8)  The writings, speeches, documents and proclamations of

12

the founding fathers and presidents of the United States.

13

(9)  Organic documents from the pre-Colonial, Colonial,

14

Revolutionary, Federalist and post-Federalist eras.

15

(10)  United States Supreme Court decisions.

16

(11)  Acts of the Congress of the United States, including

17

the published text of the Congressional Record.

18

(b)  There shall be no content-based censorship of American

19

history or heritage in this Commonwealth based on religious or

20

other references in the writings, documents and records

21

enumerated in subsection (a).

22

(c)  The Secretary of Education shall distribute a copy of

23

this section immediately to each board of school directors.

24

Section 2.  This act shall take effect in 60 days.
