AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

tolling of limitations in civil actions because of infancy,

4

insanity or imprisonment.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Section 5533(b) of Title 42 of the Pennsylvania

8

Consolidated Statutes is amended by adding a paragraph to read:

§ 5533.  Infancy, insanity or imprisonment.

(b)  Infancy.--

(3)  Notwithstanding any other provision of law, a civil

14

action arising from childhood sexual abuse which is subject

15

to paragraph (2) but would be barred as of July 1, 2011,

16

solely because the statute of limitations has expired, is

17

revived and such a civil action may be commenced within two

18

years of July 1, 2011. Nothing in this paragraph shall be

construed to alter the applicable statute of limitations

2

period of a civil action arising from childhood sexual abuse

3

which is not time barred as of July 1, 2011.

Section 2.  This act shall take effect in 60 days.
