AN ACT

Amending the act of March 24, 2004 (P.L.148, No.15), entitled

2

"An act providing for the availability of and access to a

3

comprehensive trauma care system; and imposing powers and

4

duties upon the Department of Public Welfare," further

5

providing for accreditation of Level III trauma centers and

6

for payment calculation of funding of trauma centers.

7

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  Sections 3 and 5(c) of the act of March 24, 2004

10

(P.L.148, No.15), known as the Pennsylvania Trauma Systems

11

Stabilization Act, are amended to read:

12

Section 3.  Accreditation of Level III trauma centers.

13

(a)  Standards.--The foundation shall accredit Level III

14

trauma centers in accordance with established standards, which

15

shall be based upon the current guidelines for trauma centers as

16

defined by the American College of Surgeons for Level III trauma

17

centers. The accreditation process shall be conducted in

compliance with section 6 of the act of July 3, 1985 (P.L.164,

2

No.45), known as the Emergency Medical Services Act.

3

(b)  Additional requirements.--In addition to the Level III

4

standards established by the foundation under subsection (a), a

5

hospital must meet all of the following criteria to qualify for

6

Level III accreditation:

7

(1)  Provide comprehensive emergency services.

8

(2)  Total on an annual basis at least 4,000 inpatient

9

admissions from its emergency department.

10

(3)  Be located in a third to eighth class county [with

11

no Level I or Level II trauma center].

12

(4)  Be located more than 25 miles travel distance from a

13

Level I or Level II trauma center.

14

(c)  Submission of application required.--To be eligible for

15

accreditation as a Level III trauma center and to qualify for

16

funds under this act, an eligible hospital must submit an

17

application to the foundation for the purpose of determining

18

compliance with the [standards under subsection (a) and the] 

<--

19

criteria under subsection (b). [No later than 30 days after the

20

effective date of this section, an application shall be

21

developed by the foundation and made available to eligible

22

hospital applicants.]

23

(d)  Review of application.--Within 120 days of the receipt

24

of an application, the foundation shall complete its review of

25

the application to determine compliance with the [standards

<--

26

under subsection (a) and the] criteria under subsection (b). No

<--

27

later than [120]240 days from the completion of [that review]a

<--

28

site survey, the foundation shall grant or deny a certificate of

29

[accreditation] continuance for up to four years, if there is

<--

30

evidence of continued development as outlined by the foundation

for those hospitals seeking to be [qualified]accredited as Level

<--

2

III trauma centers.

3

(e)  Review of Level III trauma centers.--No later than five

4

years after the effective date of this section, the foundation

5

shall reassess the impact of Level III trauma centers on patient

6

outcomes and on the trauma system as a whole. The report with

7

recommendations shall be forwarded to the Secretary of Health,

8

the Public Health and Welfare Committee of the Senate and the

9

Health and Human Services Committee of the House of

10

Representatives.

11

(f)  Other trauma center references.--A Level III trauma

12

center accredited under this act shall not be considered an

13

accredited trauma center for purposes of any other act.

14

Section 5.  Funding.

15

(c)  Payment calculation.--

17

(1)  Payment to qualified hospitals shall be allocated as

18

follows:

19

(i)  Ninety percent of available funds shall be

20

allocated to hospitals accredited as Level I and Level II

21

trauma centers.

22

(ii)  The remaining 10% shall be allocated to

23

hospitals accredited as Level III trauma centers and

hospitals pursuing Level III accreditation for up to four

25

years with documented evidence of progression toward

26

accreditation as verified by the foundation.

27

(2)  Payment to each qualifying hospital accredited as a

28

Level I or Level II trauma center shall be calculated using

29

data provided by the foundation as follows:

(i)  Fifty percent of the total amount available for

Level I and Level II trauma centers shall be allocated

2

equally among Level I and Level II trauma centers.

3

(ii)  Fifty percent of the total amount available for

4

Level I and Level II trauma centers shall be allocated on

5

the basis of each trauma center's percentage of medical

6

assistance and uninsured trauma cases and patient days

7

compared to the Statewide total number of medical

8

assistance and uninsured trauma cases and patient days

9

for all Level I and Level II trauma centers.

10

(3)  Subject to paragraph (4), payment to each qualifying

11

hospital accredited or seeking accreditation as a Level III

12

trauma center shall be calculated using the information and

13

data provided by the foundation as follows:

14

(i)  Fifty percent of the total amount available for

15

Level III trauma centers shall be allocated equally among

16

all Level III trauma centers.

17

(ii)  Fifty percent of the total amount available for

18

Level III trauma centers shall be allocated on the basis

19

of each trauma center's percentage of medical assistance

20

and uninsured trauma cases and patient days compared to

21

the Statewide total number of medical assistance and

22

uninsured trauma cases and patient days for all Level III

23

trauma centers.

24

(4)  Payment to each qualifying hospital accredited as a

25

Level III may not be greater than 50% of the average

26

Statewide annual payment to a Level II trauma center as

27

determined in the methodology described in paragraph (2).

28

Section 2.  This act shall take effect immediately.
