| AN ACT |
| |
1 | Amending the act of June 3, 1937 (P.L.1333, No.320), entitled |
2 | "An act concerning elections, including general, municipal, |
3 | special and primary elections, the nomination of candidates, |
4 | primary and election expenses and election contests; creating |
5 | and defining membership of county boards of elections; |
6 | imposing duties upon the Secretary of the Commonwealth, |
7 | courts, county boards of elections, county commissioners; |
8 | imposing penalties for violation of the act, and codifying, |
9 | revising and consolidating the laws relating thereto; and |
10 | repealing certain acts and parts of acts relating to |
11 | elections," prohibiting certain contributions by wine and |
12 | spirit store licensees and affiliated persons. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. The act of June 3, 1937 (P.L.1333, No.320), known |
16 | as the Pennsylvania Election Code, is amended by adding a |
17 | section to read: |
18 | Section 1633.1. Contributions by Wine and Spirit Store |
19 | Licensees and Affiliated Persons.--(a) To prevent the actual or |
20 | appearance of corruption that may result from campaign |
21 | contributions by individuals associated with the highly |
22 | regulated wine and spirit stores and notwithstanding any other |

1 | provision of law, the following persons shall be prohibited from |
2 | contributing any money or in-kind contribution to a candidate |
3 | for nomination or election to any public office in this |
4 | Commonwealth, or to any political party committee or other |
5 | political committee in this Commonwealth or to any group, |
6 | committee or association organized in support of a candidate, |
7 | political party committee or other political committee in this |
8 | Commonwealth: |
9 | (1) An applicant for a license. |
10 | (2) A licensee. |
11 | (3) A principal or key employe of an applicant or licensee. |
12 | (4) An affiliate, intermediary, subsidiary or holding |
13 | company of an applicant or a licensee. |
14 | (5) A principal or key employe of an affiliate, |
15 | intermediary, subsidiary or holding company of an applicant or a |
16 | licensee. |
17 | (6) A person who holds a similar license in another |
18 | jurisdiction outside of this Commonwealth and the affiliates, |
19 | intermediaries, subsidiaries, holding companies, principals or |
20 | key employes of that person. |
21 | (b) The individuals prohibited from making political |
22 | contributions under subsection (a) shall not make a political |
23 | contribution of money or an in-kind contribution to any |
24 | association or organization, including a nonprofit organization, |
25 | that has been solicited by, or knowing that the contribution or |
26 | a portion thereof will be contributed to, the elected official, |
27 | executive-level public employe or candidate for nomination or |
28 | election to a public office in this Commonwealth. |
29 | (c) (1) The first violation of this section by a person |
30 | listed under subsection (a), or any person that holds a |

1 | controlling interest in that entity, or a subsidiary company |
2 | thereof, and any officer, director or management-level employe |
3 | of that entity shall be punishable by a fine of not less than |
4 | two thousand five hundred dollars ($2,500). |
5 | (2) A second violation of this section, within five (5) |
6 | years of the first violation, shall be punishable by at least a |
7 | one-day suspension of the license held by the entity and a fine |
8 | of not less than five thousand dollars ($5,000). |
9 | (3) A third violation of this section within five (5) years |
10 | of the second violation shall be punishable by the immediate |
11 | revocation of the license held by the entity. |
12 | (4) In addition to any fine or sanction that may be imposed |
13 | by the board, any person who makes a contribution in violation |
14 | of this section commits a misdemeanor of the third degree. |
15 | (d) As used in this section, the following words and phrases |
16 | shall have the meanings given to them in this subsection: |
17 | "Contribution." Any payment, gift, subscription, assessment, |
18 | contract, payment for services, dues, loan, forbearance, advance |
19 | or deposit of money or any valuable thing made to a candidate or |
20 | political committee for the purpose of influencing any election |
21 | in this Commonwealth or for paying debts incurred by or for a |
22 | candidate or committee before or after any election. The term |
23 | shall include: |
24 | (1) The purchase of tickets for events including dinners, |
25 | luncheons, rallies and other fundraising events. |
26 | (2) The granting of discounts or rebates not available to |
27 | the general public or the granting of discounts or rebates by |
28 | television and radio stations and newspapers not extended on an |
29 | equal basis to all candidates for the same office. |
30 | (3) Any payments provided for the benefit of any candidate, |

1 | including payments for the services of a person serving as an |
2 | agent of a candidate or committee by a person other than the |
3 | candidate or committee or person whose expenditures the |
4 | candidate or committee must report. |
5 | (4) Any receipt or use of anything of value received by a |
6 | political committee from another political committee and also |
7 | includes any return on investments by a political committee. |
8 | "License." Any of the following: |
9 | (1) A license for the operation of a wine and spirits store |
10 | for the retail sale of wine and liquor for off-premises |
11 | consumption. |
12 | (2) A license for the operation of a wine and spirits |
13 | wholesale and warehousing business for the sale of wine and |
14 | spirits to retail licensees that are authorized to sell wine and |
15 | spirits for on-premises and off-premises consumption. |
16 | "Licensee." A person who holds a license. |
17 | "Political committee." Any committee, club, association or |
18 | other group of persons which receives contributions or makes |
19 | expenditures. |
20 | Section 2. The Secretary of State shall, upon the |
21 | privatization of the State stores selling liquor in this |
22 | Commonwealth, submit notice of the privatization to the |
23 | Legislative Reference Bureau for publication in the Pennsylvania |
24 | Bulletin. |
25 | Section 3. This act shall take effect upon publication of |
26 | the notice under section 2. |
