| A RESOLUTION |
| |
1 | Directing the Legislative Budget and Finance Committee to study |
2 | and issue a report to the General Assembly on the impact of |
3 | expanding the powers and duties of the Department of Aging to |
4 | include administration of certain programs currently |
5 | administered by the Department of Public Welfare. |
6 | WHEREAS, The Department of Aging was established by statute |
7 | on June 20, 1978, to operate independently of the Department of |
8 | Public Welfare; and |
9 | WHEREAS, The expressed purpose of establishing the Department |
10 | of Aging was to provide a cabinet-level State agency whose |
11 | jurisdiction, powers and duties specifically concern and are |
12 | directed to advancing the well-being of Pennsylvania’s older |
13 | citizens; and |
14 | WHEREAS, Pennsylvania has the third largest percentage of |
15 | elderly residents in the country, with 20%, or one out of every |
16 | five people in this Commonwealth, who are at least 60 years of |
17 | age; and |

1 | WHEREAS, Specifically there are approximately 2.5 million |
2 | Pennsylvanians over 60 years of age and more than 302,000 |
3 | Pennsylvanians over 85 years of age; and |
4 | WHEREAS, Over the next ten years, the number of people who |
5 | will be at least 60 years of age is projected to increase by |
6 | approximately 9% to 2.6 million people, and the number of people |
7 | who will be at least 85 years of age will increase by more than |
8 | 50% to 365,000; and |
9 | WHEREAS, On August 26, 1971, the Pennsylvania Lottery Fund |
10 | was established by the act of August 26, 1971 (P.L.351, No.91), |
11 | known as the State Lottery Law, for the sole purpose of |
12 | providing benefits such as prescription assistance, property tax |
13 | and rent rebates, the Shared-Ride Program and fixed route |
14 | transportation, and home-based and community-based services |
15 | through the network of 52 local area agencies on aging and |
16 | approximately 650 senior community centers; and |
17 | WHEREAS, A proposal has been made by the Governor's |
18 | administration to create a new department that would merge the |
19 | Department of Aging with the Office of Long Term Living and |
20 | eight existing Medicaid waiver programs; and |
21 | WHEREAS, Some of the programs and services proposed to be |
22 | transferred to the Department of Aging are designed to focus on |
23 | the needs of under-60 populations; and |
24 | WHEREAS, The proposed merger would result in changing the |
25 | current sole focus of the department from aging issues to |
26 | aging-related and disability-related issues not limited to older |
27 | citizens, which may not only have policy implications, but also |
28 | budget and fiscal implications; and |
29 | WHEREAS, Several other states have experienced similar state |
30 | agency reorganizations, and it is important to draw upon those |

1 | experiences in order to assure older adults, as well as persons |
2 | with disabilities, that the most reasonable and workable |
3 | reorganization will occur and result in an agency that best |
4 | represents the needs of older adults and persons with |
5 | disabilities in this Commonwealth; and |
6 | WHEREAS, The Legislative Budget and Finance Committee is a |
7 | bipartisan, bicameral legislative services agency whose purpose |
8 | is to conduct studies and make recommendations aimed at |
9 | eliminating unnecessary expenditures, promoting economy in State |
10 | government and assuring that State funds are being expended in |
11 | accordance with legislative intent and law; and |
12 | WHEREAS, In order to carry out its mandates, the Legislative |
13 | Budget and Finance Committee is authorized to conduct a wide |
14 | range of research activities pertaining to the operation and |
15 | performance of State-funded programs and agencies; therefore be |
16 | it |
17 | RESOLVED, That the House of Representatives direct the |
18 | Legislative Budget and Finance Committee to study the economic |
19 | impact of establishing a new department that would combine the |
20 | Department of Aging, the Office of Long Term Living and eight |
21 | Medicaid waiver programs and to study the potential risks and |
22 | benefits such activity would have on this Commonwealth; and be |
23 | it further |
24 | RESOLVED, That the Legislative Budget and Finance Committee |
25 | solicit input from the stakeholder groups that will be affected |
26 | by the creation of such a department; and be it further |
27 | RESOLVED, That the Legislative Budget and Finance Committee |
28 | prepare a report of its findings which shall include, at a |
29 | minimum, all of the following: |
30 | (1) identification of all federally and State mandated |

1 | programs and services that will be affected by the |
2 | establishment of a new department through combining the |
3 | Department of Aging, the Office of Long Term Living and the |
4 | eight Medicaid waiver programs; |
5 | (2) identification of revenues and expenditures by |
6 | source and amount for each of the programs and services; |
7 | (3) identification of the number of persons served by |
8 | each of the programs and services and their ages; and |
9 | (4) identification of other states that have an aging- |
10 | related department or agency that is organized in a similar |
11 | manner to the merger which is being proposed, including |
12 | information regarding the economic impact of reorganization |
13 | as well as any risks or benefits experienced by those states |
14 | as a result of reorganization; |
15 | and be it further |
16 | RESOLVED, That a copy of the report be transmitted to the |
17 | majority and minority chairmen of the Aging and Older Adult |
18 | Services Committee, the Appropriations Committee and the Health |
19 | and Human Services Committee of the House of Representatives no |
20 | later than May 29, 2009. |
