Bill Title: Urging the Insurance Commissioner to investigate the prevalence of the practice by which motor vehicle insurers coerce or otherwise attempt to aggressively direct their insureds who have filed claims for damaged motor vehicles to use motor vehicle repair shops that have been preapproved by the insurer or that are affiliated with the insurer, thereby restricting or adversely affecting the choice of the insureds to select repair shops of their own choice.

A RESOLUTION

Urging the Insurance Commissioner to investigate the prevalence

of the practice by which motor vehicle insurers coerce or

3

otherwise attempt to aggressively direct their insureds who

4

have filed claims for damaged motor vehicles to use motor

5

vehicle repair shops that have been preapproved by the

6

insurer or that are affiliated with the insurer, thereby

7

restricting or adversely affecting the choice of the insureds

8

to select repair shops of their own choice.

WHEREAS, It appears that motor vehicle insurers coerce or

10

otherwise attempt to aggressively direct their insureds who have

11

filed claims for damaged motor vehicles to use motor vehicle

12

repair shops that have been preapproved by the insurer or that

13

are affiliated with the insurer; and

14

WHEREAS, Such activity by an insured restricts or adversely

15

affects the choice of its insureds to select repair shops of

16

their own choice; and

17

WHEREAS, There is concern that this activity may be a

18

widespread insurance practice in this Commonwealth; and

19

WHEREAS, The Insurance Commissioner is the State official

20

best suited to investigate the prevalence of this activity

throughout this Commonwealth; therefore be it

RESOLVED, That the House of Representatives urge the

3

Insurance Commissioner to investigate the prevalence of the

4

practice by which motor vehicle insurers coerce or otherwise

5

attempt to aggressively direct their insureds who have filed

6

claims for damaged motor vehicles to use motor vehicle repair

7

shops that have been pre-approved by the insurer or that are

8

affiliated with the insurer, thereby restricting or adversely

9

affecting the choice of the insureds to select repair shops of

10

their own choice; and be it further

11

RESOLVED, That the House of Representatives urge the

12

Insurance Commissioner to report the findings of its

13

investigation to the General Assembly within six months of the

14

adoption of this resolution.
