State Expenditure

This bill modifies language in reference to a person who has been issued a commercial driver license and drives a commercial motor vehicle. The bill does not require any agency action and does not operationally or fiscally impact state agencies or local governments. Therefore, the bill does not have an expenditure impact on the general fund, federal funds, or other funds.

A BILL

TO AMEND SECTION 56-1-2150, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE QUALIFICATIONS A PERSON MUST POSSESS TO DRIVE A COMMERCIAL MOTOR VEHICLE, SO AS TO PROVIDE A PERSON WHO HAS A COMMERCIAL DRIVER LICENSE IS PRESUMED TO POSSESS THE QUALIFICATIONS TO DRIVE A COMMERCIAL MOTOR VEHICLE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 56-1-2150 is amended to read:

"Section 56-1-2150.    A person may is presumed to possess the qualifications necessary to be hired and entrusted to drive a commercial motor vehicle if the person has a commercial driver license issued by a state in accordance with the minimum federal standards for the issuance of commercial motor vehicle driver licenses, if the person's license is not suspended, revoked, or cancelled and if the person is not disqualified from driving a commercial motor vehicle."

SECTION    2.    This act takes effect upon approval by the Governor.
