relating to access by certain persons to a first responder's | ||
immunization history during a disaster. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 161, Health and Safety | ||
Code, is amended by adding Section 161.00708 to read as follows: | ||
Sec. 161.00708. ACCESS TO FIRST RESPONDER IMMUNIZATION | ||
HISTORY. (a) In this section, "disaster" means a disaster declared | ||
by the president of the United States, the governor of this state, | ||
or the governor of another state. | ||
(b) The executive commissioner by rule shall establish a | ||
process to allow during a disaster direct access to the | ||
immunization registry for verification of a first responder's | ||
immunization history by: | ||
(1) the first responder; and | ||
(2) during the preparation for or response to the | ||
disaster and with the first responder's electronic or written | ||
consent: | ||
(A) the first responder's employer; or | ||
(B) a person other than the first responder's | ||
employer who is acting as the first responder's supervisor for the | ||
disaster. | ||
SECTION 2. Not later than January 1, 2020, the executive | ||
commissioner of the Health and Human Services Commission shall | ||
adopt rules to implement Section 161.00708, Health and Safety Code, | ||
as added by this Act. | ||
SECTION 3. This Act takes effect September 1, 2019. |
