A BILL TO BE ENTITLED
 
AN ACT
  relating to access by certain persons to a first responder's
  immunization history during a disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 161, Health and Safety
  Code, is amended by adding Section 161.00708 to read as follows:
         Sec. 161.00708.  ACCESS TO FIRST RESPONDER IMMUNIZATION
  HISTORY. (a) In this section, "disaster" means a disaster declared
  by the president of the United States, the governor of this state,
  or the governor of another state.
         (b)  The executive commissioner by rule shall establish a
  process to allow during a disaster direct access to the
  immunization registry for verification of a first responder's
  immunization history by:
               (1)  the first responder; and
               (2)  during the preparation for or response to the
  disaster and with the first responder's electronic or written
  consent:
                     (A)  the first responder's employer; or
                     (B)  a person other than the first responder's
  employer who is acting as the first responder's supervisor for the
  disaster.
         SECTION 2.  Not later than January 1, 2020, the executive
  commissioner of the Health and Human Services Commission shall
  adopt rules to implement Section 161.00708, Health and Safety Code,
  as added by this Act.
         SECTION 3.  This Act takes effect September 1, 2019.
