relating to a competitive bidding requirement exemption for certain | ||
county sole-source purchases of road construction or maintenance | ||
materials. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 252.312, Transportation Code, is amended | ||
by amending Subsections (a) and (c) and adding Subsection (b-1) to | ||
read as follows: | ||
(a) Except as provided by Subsections [ |

(b-1), the commissioners court shall purchase the equipment, | ||
materials, and supplies for the county road department through | ||
competitive bidding in conformity with estimates and | ||
specifications prepared by the county road engineer. | ||
(b-1) A purchase in an amount of $100,000 or less of road | ||
construction or maintenance materials available for purchase from | ||
only one supplier may be made without advertising for competitive | ||
bids or complying with any other competitive procurement | ||
requirement. | ||
(c) A purchase may not be divided or reduced to avoid the | ||
competitive bidding requirement [ |

SECTION 2. Section 252.312, Transportation Code, as amended | ||
by this Act, applies only to a purchase commenced on or after the | ||
effective date of this Act. A purchase for which competitive bids | ||
are advertised before the effective date of this Act is governed by | ||
the law in effect on the date the bids were advertised, and that law | ||
is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2019. |
