relating to termination by a managed care organization of a | ||
provider's participation in Medicaid and child health plan program | ||
provider networks. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 533.006, Government Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) A managed care organization may not terminate a health | ||
care provider's participation in the organization's provider | ||
network without cause. | ||
SECTION 2. Section 62.155, Health and Safety Code, is | ||
amended by adding Subsection (e) to read as follows: | ||
(e) A managed care organization or other entity selected as | ||
a health plan provider under the child health plan program may not | ||
terminate a health care provider's participation in the | ||
organization's or entity's provider network without cause. | ||
SECTION 3. The changes in law made by this Act apply to a | ||
contract between a managed care organization or other entity and a | ||
health care provider entered into or renewed on or after the | ||
effective date of this Act. A contract entered into or renewed | ||
before that date is governed by the law in effect on the date the | ||
contract was entered into or renewed, and that law is continued in | ||
effect for that purpose. | ||
SECTION 4. If before implementing any provision of this Act | ||
a state agency determines that a waiver or authorization from a | ||
federal agency is necessary for implementation of that provision, | ||
the agency affected by the provision shall request the waiver or | ||
authorization and may delay implementing that provision until the | ||
waiver or authorization is granted. | ||
SECTION 5. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
