| infrastructure projects. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 222, Transportation Code, | ||
| is amended by adding Section 222.036 to read as follows: | ||
| Sec. 222.036. DESIGNATION OF CERTAIN FUNDS FOR BORDER | ||
| INFRASTRUCTURE PROJECTS. As authorized by the Fixing America's | ||
| Surface Transportation Act (Pub. L. No. 114-94) or other similar | ||
| federal law, the governor shall, each fiscal year, designate at | ||
| least five percent of funds available to this state under 23 U.S.C. | ||
| Section 133(d)(1)(B) for border infrastructure projects. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
