A BILL TO BE ENTITLED
 
AN ACT
  relating to reporting requirements regarding eminent domain
  authority.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2206.154, Government Code, is amended by
  amending Subsection (c) and adding Subsections (d) and (e) to read
  as follows:
         (c)  In addition to the annual report required under
  Subsection (a), an entity described by Section 2206.151 shall
  report to the comptroller any changes to the entity's eminent
  domain authority information reported under this section not later
  than the 90th day after the date on which the change occurred,
  except as provided by Subsection (d).
         (d)  If, in a proceeding in a state court of competent
  jurisdiction, the court finds that an entity that claimed in a
  report submitted to the comptroller under Subsection (a) to have
  eminent domain authority does not have eminent domain authority,
  the entity shall report the court's finding to the comptroller not
  later than the 30th day after the date the proceeding is completed.
         (e)  If an entity reports a finding under Subsection (d), the
  comptroller as soon as practicable after receiving the information
  shall reflect the finding in the eminent domain database by
  including the entity on a separately maintained list of entities
  that a court has found do not have eminent domain authority.
         SECTION 2.  This Act takes effect September 1, 2019.
