A BILL TO BE ENTITLED
 
AN ACT
  relating to the obligation of a defendant to pay court-ordered
  restitution.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article 42.037, Code of Criminal Procedure, is
  amended by adding Subsection (h-1) to read as follows:
         (h-1)  The duty to pay the restitution ordered under this
  article remains with the defendant until full restitution is paid,
  regardless of whether the defendant is serving a term of
  confinement or is under any form of state supervision. The amount of
  any unpaid restitution ordered under this article:
               (1)  is subject to withdrawal from an inmate account in
  accordance with Section 501.014, Government Code, if the defendant
  is confined in a facility operated by or under contract with the
  Texas Department of Criminal Justice; and
               (2)  may be collected as a condition of community
  supervision, parole, or mandatory supervision, if the defendant is
  under state supervision.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
