A BILL TO BE ENTITLED
 
AN ACT
  relating to the duty of a county to refund an amount of $5 or less
  paid to the county clerk.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 130, Local Government
  Code, is amended by adding Section 130.911 to read as follows:
         Sec. 130.911.  COUNTY REFUND OF SMALL AMOUNT.  A county is
  not required to refund an amount overpaid or otherwise paid in error
  to the county clerk by a person if:
               (1)  that amount is $5 or less;
               (2)  the county clerk notifies the person by mail of the
  amount overpaid or paid in error and includes with the notice a form
  for requesting a refund; and
               (3)  the person fails to request a refund before the
  90th day after the date the clerk mailed the notice.
         SECTION 2.  This Act takes effect September 1, 2019.
