relating to the revocation of community supervision for a violation | ||
of a condition of community supervision involving the commission of | ||
an offense. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article 42A.751, Code of Criminal Procedure, is | ||
amended by adding Subsection (h-1) to read as follows: | ||
(h-1) Notwithstanding Subsection (d), the court may not | ||
revoke the community supervision of a defendant for a violation of a | ||
condition of community supervision that involves being arrested for | ||
or charged with an offense unless: | ||
(1) the person is convicted of the offense; or | ||
(2) the offense is an offense under Title 5, Penal | ||
Code, or listed in Article 42A.054(a). | ||
SECTION 2. The change in law made by this Act applies to a | ||
person on community supervision on or after the effective date of | ||
this Act, regardless of whether the person was placed on community | ||
supervision before, on, or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2019. |
