A BILL TO BE ENTITLED
 
AN ACT
  relating to distance requirements for premises issued a package
  store permit.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 22, Alcoholic Beverage Code, is amended
  by adding Section 22.18 to read as follows:
         Sec. 22.18.  DISTANCE FROM OTHER PACKAGE STORES. Except as
  provided by Section 109.59, on or after September 1, 2019, the
  commission may not issue a permit under this chapter for a premises
  that is located within 5000 feet of the premises of another package
  store permittee.
         SECTION 2.  Section 109.59(a), Alcoholic Beverage Code, is
  amended to read as follows:
         (a)  If at the time an original alcoholic beverage permit or
  license is granted for a premises the premises satisfies the
  requirements regarding distance from schools, churches, and other
  types of premises established in this code, including Section
  22.18,
  and any other law or ordinance of the state or a political
  subdivision of the state in effect at that time, the premises shall
  be deemed to satisfy the distance requirements for all subsequent
  renewals of the license or permit.
         SECTION 3.  This Act takes effect September 1, 2019.
