| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 67, Water Code, is amended by adding | ||
| Section 67.0115 to read as follows: | ||
| Sec. 67.0115. LIMITATION ON FEES FOR SCHOOL DISTRICTS. (a) | ||
| In this section, "impact fee" means a charge imposed by a | ||
| corporation against new development to pay for capital improvements | ||
| or facility expansions necessitated by the new development. The | ||
| term includes amortized charges, lump-sum charges, capital | ||
| recovery fees, contributions in aid of construction, and any other | ||
| fee that functions as described by this definition. | ||
| (b) A corporation may not charge a school district an impact | ||
| fee or a fee to acquire water rights unless the board of trustees of | ||
| the district enters into a contract with the corporation for | ||
| payment of the fees. The contract may contain terms the board of | ||
| trustees considers advisable to provide for payment of the fees. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
