A BILL TO BE ENTITLED
 
AN ACT
  relating to billing requirements for certain health care
  facilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 324, Health and Safety
  Code, is amended by adding Section 324.1015 to read as follows:
         Sec. 324.1015.  BILLING STATEMENT; CIVIL LIABILITY. (a) A
  facility's billing statement to a consumer must include:
               (1)  an itemized list of each health care service
  provided to the consumer;
               (2)  an itemized list of each health care supply
  provided to the consumer; and
               (3)  a list of each physician or other health care
  practitioner licensed to provide health care in this state who
  provided a health care service to the consumer.
         (b)  A consumer is not liable to a facility for any billed
  charge on a billing statement that violates this section. If a
  facility files a civil action against a consumer for a charge
  described by this subsection and the consumer prevails in the
  action, the consumer may recover reasonable attorney's fees and
  costs.
         SECTION 2.  Section 324.1015, Health and Safety Code, as
  added by this Act, applies only to a health care service provided on
  or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2019.
