relating to the authority of a peace officer to take a blood | ||
specimen from the operator of a motor vehicle or watercraft to test | ||
for alcohol concentration or the presence of other intoxicating | ||
substances. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 724.017, Transportation Code, is amended | ||
by adding Subsection (e) to read as follows: | ||
(e) A person who is a peace officer may not take a blood | ||
specimen under this chapter regardless of whether the person is | ||
otherwise authorized to take a blood specimen under this section. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
