A BILL TO BE ENTITLED
 
AN ACT
  relating to the filing fee for certain candidates.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 142.004(b), Election Code, is amended to
  read as follows:
         (b)  An application must, in addition to complying with
  Section 141.031, be accompanied by the appropriate filing fee or a
  petition in lieu of the filing fee that satisfies the requirements
  prescribed by Section 141.062.
         SECTION 2.  Chapter 142, Election Code, is amended by adding
  Section 142.0041 to read as follows:
         Sec. 142.0041.  FILING FEE. (a) The filing fee for an
  independent candidate is the amount prescribed by Section 172.024
  for a candidate for nomination for the same office in a general
  primary election.
         (b)  A filing fee received by the secretary of state shall be
  deposited in the state treasury to the credit of the general revenue
  fund.
         (c)  A filing fee received by the county judge shall be
  deposited in the county treasury to the credit of the county general
  fund.
         SECTION 3.  Section 181.031, Election Code, is amended by
  adding Subsections (d), (e), and (f) to read as follows:
         (d)  In addition to the requirements prescribed by Section
  141.031, the application must be accompanied by a filing fee or a
  petition in lieu of the filing fee that satisfies the requirements
  imposed by Section 141.062.
         (e)  The amount of the filing fee imposed under Subsection
  (d) is the amount prescribed by Section 172.024 for a candidate for
  nomination for the same office in a general primary election.
         (f)  A filing fee under this section is to be delivered to the
  appropriate party official under Section 181.032(a) for party use.
         SECTION 4.  This Act takes effect September 1, 2019.
