BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article I, Texas Constitution, is amended by | ||
adding Section 35 to read as follows: | ||
Sec. 35. (a) An individual has the right to engage in a | ||
lawful occupation or profession free from unnecessary regulation. | ||
(b) This state or a political subdivision of this state may | ||
not enact or enforce a regulation that imposes a substantial burden | ||
on an individual's right to engage in a lawful occupation or | ||
profession unless the regulation is necessary and narrowly tailored | ||
to protect against actual and specific harm to the public's health | ||
and safety. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held on November 2, | ||
2021. The ballot shall be printed to permit voting for or against | ||
the proposition: "The constitutional amendment protecting an | ||
individual's right to earn a living free from unnecessary | ||
governmental interference." |
