A BILL TO BE ENTITLED
|

AN ACT
|

relating to the precedence of election contests in district and |
|
appellate courts. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 231.009, Election Code, is amended to |
|
read as follows: |
|
Sec. 231.009. PRECEDENCE OF ELECTION CONTEST [ON APPEAL]. |
|
An election contest has precedence in the district and appellate |
|
courts and shall be disposed of as expeditiously as practicable. A |
|
court must to the extent reasonably possible ensure that the action |
|
is brought to final disposition before the expiration of the term of |
|
the contested office. |
|
SECTION 2. The change in law made by this Act applies only |
|
to an election contest filed on or after the effective date of this |
|
Act. An election contest filed before the effective date of this Act |
|
is governed by the law as it existed immediately before the |
|
effective date of this Act, and that law is continued in effect for |
|
that purpose. |
|
SECTION 3. This Act takes effect September 1, 2019. |
