relating to the fee collected for a municipal solid waste permit | ||
application; increasing a fee. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 5.701, Water Code, is amended by adding | ||
Subsection (r) to read as follows: | ||
(r) The executive director shall charge a fee for filing a | ||
municipal solid waste permit application under Chapter 361, Health | ||
and Safety Code, in the amount of $5,000 plus the cost of required | ||
notice. Money collected under this subsection may only be used to | ||
inspect the facility or site used or proposed to be used to store, | ||
process, or dispose of municipal solid waste to confirm information | ||
included in the permit application. The inspection shall be | ||
conducted prior to the issuance of a permit. The commission by rule | ||
shall prescribe the kinds of information in a permit application | ||
that require confirmation under this subsection. The inspection | ||
shall include an investigation for any unique, site-specific | ||
conditions that are relevant to a determination regarding the | ||
suitability of the site for operation of a landfill. Application | ||
fees collected under this subsection shall be deposited to the | ||
credit of the waste management account. | ||
SECTION 2. The changes in law made by this Act apply only to | ||
an application for a permit authorization for a municipal solid | ||
waste facility that is filed with the Texas Commission on | ||
Environmental Quality on or after the effective date of this Act. | ||
An application for a permit for a municipal solid waste facility | ||
that is filed before the effective date of this Act is governed by | ||
the law in effect on the date of filing, and that law is continued in | ||
effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2019. |
