A BILL TO BE ENTITLED
 
AN ACT
  relating to wage claim data.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 301, Labor Code, is
  amended by adding Section 301.0851 to read as follows:
         Sec. 301.0851.  WAGE CLAIM DATA. (a)  In this section,
  "wage claim data" means information collected, received,
  developed, or maintained in the records of the commission that
  relates to the administration of Chapter 61. The term does not
  include:
               (1)  aggregated data that does not tend to identify an
  individual; or
               (2)  information regarding a violation or the
  enforcement of Chapter 61.
         (b)  The commission shall adopt and enforce reasonable rules
  governing the confidentiality, custody, use, preservation, and
  disclosure of wage claim data. The rules must:
               (1)  include safeguards to protect the confidentiality
  of identifying information regarding any individual or any past or
  present employer or employing unit contained in the wage claim
  data, including any information that foreseeably could be combined
  with other publicly available information to reveal identifying
  information regarding the individual, employer, or employing unit,
  as applicable; and
               (2)  allow for the sharing of wage claim data with other
  state agencies that agree to the confidentiality standards adopted
  by the commission for that data.
         (c)  Wage claim data is not public information for purposes
  of Chapter 552, Government Code.
         (d)  The commission may adopt rules governing the disclosure
  of:
               (1)  aggregated data that does not tend to identify an
  individual; or
               (2)  information regarding a violation or the
  enforcement of Chapter 61.
         SECTION 2.  This Act takes effect September 1, 2019.
