| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 361.0961, Health and Safety Code, is | ||
| amended by adding Subsection (d) to read as follows: | ||
| (d) In this section, "container or package" does not include | ||
| a single-use bag provided by a retail business to a customer at the | ||
| point of sale for the purpose of transporting purchases. | ||
| SECTION 2. The change in law made by this Act is intended | ||
| only to clarify existing law with respect to local government | ||
| prohibitions or restrictions on the sale or use of a container or | ||
| package. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
