AMENDMENT IN THE NATURE OF A SUBSTITUTE

Senate Amendments in [ ] – February 1, 2019
A BILL to require the Secretary of Public Safety and Homeland Security to convene a work group to develop a strategy for producing and publishing a comprehensive report on the use of force by Virginia law-enforcement officers, correctional officers, and jail officers.

Be it enacted by the General Assembly of Virginia:

1.    §1. That the Secretary of Public Safety and Homeland Security shall convene a work group that shall include representatives from the Departments of Corrections and State Police and the Board of Corrections, as well as representatives from local police departments, sheriffs' offices, local correctional facilities, and other interested stakeholder groups, to develop a strategy for producing and publishing a comprehensive report on the use of force by Virginia law-enforcement officers, correctional officers, and jail officers. In developing a strategy for producing and publishing such a report, the work group shall consider how to best collect and report, if possible, the following information: (i) the date, time, and location of the incident; (ii) the number of law-enforcement officers, correctional officers, or jail officers involved in the incident; (iii) the basis for the contact that gave rise to the incident; (iv) the age, sex, gender identity, national origin, race, ethnicity, English proficiency status, and developmental or intellectual disability status, as those terms are defined in §37.2-100 of the Code of Virginia, of the civilian or inmate; (v) the force used in the incident, including the types of any weapons used; (vi) the type of serious bodily injury or cause of death of the civilian or inmate, if applicable; (vii) whether the civilian resisted and the type of resistance, if applicable; (viii) any apparent or known impairment in the physical condition of the civilian or inmate, including drug or alcohol impairment, if applicable; (ix) whether, at any time during the incident, the civilian or inmate was armed or believed to be armed with a weapon; (x) the age, sex, gender identity, national origin, race, ethnicity, and English proficiency status of the law-enforcement officer, correctional officer, or jail officer; and (xi) whether the law-enforcement officer, correctional officer, or jail officer was on duty at the time of the incident. The work group shall also consider technology solutions to eliminate duplicative reporting and to streamline compilation of data. The work group shall report its progress and the outcomes of its activities to the Governor and the General Assembly by December 1, 2019.

[ 2. That the provisions of this act shall not become effective unless an appropriation effectuating the purposes of this act is included in a general appropriation act passed in 2019 by the General Assembly that becomes law. ]
