A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §12-4-7a, relating to requiring state, county, and municipal government agencies to provide all employees an annual statement of total compensation; providing the annual statement of compensation for all employees to the State Auditor; and requiring the State Auditor to post information relating to the annual statement of total compensation for all employees at all agencies.

Be it enacted by the Legislature of West Virginia:

§12-4-7a. State, county, and municipal government transparency.

(a) All state, county, and municipal government agencies are required to provide to their employees an annual statement of total compensation within 30 days after the close of each fiscal year. The annual statement of total compensation must include information regarding salary and employer paid benefit costs, including, but not limited to, payroll taxes, medical insurance premiums, dental insurance premiums, disability insurance premiums, life and accident insurance premiums, unemployment contributions, retirement contributions, and bonuses. The annual statement of total compensation shall be provided in an electronic format. A paper format may be available upon the employee’s written request.

(b) All state, county, and municipal government agencies shall provide the State Auditor with an annual statement of total compensation for each employee within 30 days of the close of the fiscal year. The annual statement of total compensation sent to the State Auditor shall be in electronic format. All state, county, and municipal government agencies must use their best efforts to redact personally identifiable information, including, but not limited to, name, address, social security number, professional title, or other potentially identifying information prior to transmitting all employee’s annual statements of total compensation to the State Auditor.

(c) The Auditor shall post on its website, all annual statements of total compensation for each employee from every state, county, and municipal government agency within 90 days after the close of the fiscal year. The Auditor shall not include any personally identifiable information posted on its website relating to an employee’s annual statement of total compensation.

 

NOTE: The purpose of this bill is to provide transparency to the West Virginia taxpayers of total compensation for state, county, and municipal employees.
