A BILL to amend the code of West Virginia, 1931, as amended, by adding thereto a new section, designated §3-5-7a, relating to establishing that no officer may qualify as a candidate for other office until he or she has resigned from the office currently held.

Be it enacted by the Legislature of West Virginia:



§3-5-7a. Candidate must resign to run for another public office.

No person currently holding a public office filled by the voters of the state or any political subdivision thereof may qualify as a candidate for another public office without resigning from the office he or she presently holds by December 1 of the election year. This provision does not prohibit current office holders from finishing their current terms. This provision does not apply to currently serving federal elected officials.

NOTE: The purpose of this bill is to establish that no officer may qualify as a candidate for other office until he or she has resigned from the officer currently held.
