A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18-2-25c, relating to requiring students to compete only against students of the same biological gender in any athletic contests or competitions in public schools.

Be it enacted by the Legislature of West Virginia:


ARTICLE 2. STATE BOARD OF EDUCATION.


§18-2-25c. Athletic contests or competitions based upon biological gender.

Every athletic contest or competition, including training and practice competitions, at any grade level at any public school, whether the competition be in-class, intramural, or interscholastic, shall be structured so that only students of the same biological gender shall compete against each other. For purposes of this section, biological gender means the gender of the student as determined at the time of birth and recorded on the student’s birth certificate.

 

NOTE: The purpose of this bill is to require students to compete only against students of the same biological gender in any athletic contests or competitions in public schools.
